IUS OMNIBUS has submitted its contribution to the Spanish Competition Authority ( CNMC)’s public consultation, due to its commitment to the effective defense of the rights and interests of consumers and taxpayers, as well as its work to promote fair and transparent competition in the markets. Ius considers that the active involvement of the public sector in this type of claim is not only legally feasible but also necessary from the point of view of the general interest.
The document outlines the scarcity of such claims by public entities, analyses the reasons for this underuse, and proposes mechanisms to improve the situation.
